1 The Trial (Sud) is one of Chekhov’s earliest published pieces, written in 1880 when he was twenty and still signing his work "Antosha Chekhonte." It belongs to the fast, broad, sketch-length comedy of these first years – built almost entirely as dialogue, with the barest stage directions, in the manner of a scene set down for a humor magazine’s readers rather than a story told by a narrator.

The setup is a mock tribunal. A village shopkeeper, Kuzma Yegorov, convenes a jury of the local worthies – the elder, the medical assistant, the sexton, a bass singer, a crony, and a gendarme visiting from town – to try his son Serapion, a barber home from the provincial capital for the holidays, on the charge of having stolen twenty-five roubles. The scene runs entirely on the collision of registers: Serapion’s half-educated, borrowed rhetoric ("theory... cannot exist without practice,I’m a living man, an animate noun-substantive") against the elder’s rustic bluntness, the sexton’s oily persuasion, and the gendarme’s parade-ground bark. Nobody in the room listens to anyone else; each pursues his own line, and the "trial" proceeds by momentum rather than by evidence.

It ends as a farce built to collapse on itself: the flogging is already under way, cheered on by the gendarme, when the money turns up in Kuzma Yegorov’s own pocket – he had put it there himself and forgotten. The apology is as perfunctory as the accusation was, and the story closes not on the reconciliation but on the gendarme, who alone in the yard goes on shouting for more punishment long after the occasion for it has vanished. Chekhov reports all of it in the same level tone, offering no verdict of his own on the cruelty or the absurdity – the reader is left to notice that the only person still demanding blood is the outsider who had no stake in the matter at all.

The cottage of Kuzma Yegorov, shopkeeper. Stifling, hot. Damned mosquitoes and flies crowd around the eyes and ears, pestering... Clouds of tobacco smoke, but the smell is not of tobacco but of salt fish. In the air, on the faces, in the whine of the mosquitoes, there is anguish.

A big table; on it a saucer with a walnut shell, scissors, a jar of green ointment, caps, empty flasks. Seated at the table: Kuzma Yegorov himself, the village elder, the medical assistant Ivanov, the sexton Feofan Manafuilov, the bass Mikhailo, his old crony Parfenty Ivanych, and a gendarme, Fortunatov, who has come from town to visit his aunt Anisya. At a respectful distance from the table stands Kuzma Yegorov’s son, Serapion, who works in town at a barbershop and has now come home to his father for the holidays. He feels very awkward, and with a trembling hand keeps plucking at his little mustache. Kuzma Yegorov’s cottage has been rented out temporarily for a medical "station," and in the front room the ailing are now waiting. They have just brought in from somewhere a peasant woman with a broken rib... She lies there, moaning, waiting for the assistant to turn his gracious attention on her at last. Under the windows a crowd has gathered to watch Kuzma Yegorov give his son a flogging.

В почтительном отдалении от стола стоит сын Кузьмы Егорова, Серапион, служащий в городе в парикмахерской и теперь приехавший к отцу на праздники. Он чувствует себя очень неловко и дрожащей рукой теребит свои усики. Избу Кузьмы Егорова временно нанимают для медицинского "пункта", и теперь в передней ожидают расслабленные. Сейчас только привезли откуда-то бабу с поломанным ребром... Она лежит, стонет и ждет, когда, наконец, фельдшер обратит на нее свое благосклонное внимание. Под окнами толпится народ, пришедший посмотреть, как Кузьма Егоров своего сына пороть будет.
"You keep saying I’m lying," says Serapion, "and so I’m not inclined to go on talking with you for long. Words, papasha, don’t get you anywhere in the nineteenth century, because theory, as you yourself are not unaware, cannot exist without practice."
– Вы всё говорите, что я вру, – говорит Серапион, – а потому я с вами говорить долго не намерен. Словами, папаша, в девятнадцатом столетии ничего не возьмешь, потому что теория, как вам самим небезызвестно, без практики существовать не может.
"Silence!" says Kuzma Yegorov sternly. "Don’t you spread your matters at me, just tell us plainly: where have you put my money?"
– Молчи! – говорит строго Кузьма Егоров. – Материй ты не разводи, а говори нам толком: куда деньги мои девал?
"Money? Hm... You’re intelligent enough a man to understand for yourself that I never touched your money. It’s not for me you save up your little bills... No need to sin about it..."
– Деньги? Гм... Вы настолько умный человек, что сами должны понимать, что я ваших денег не трогал. Бумажки свои вы не для меня копите... Грешить нечего...
"Serapion Kosmich, you be frank with us," says the sexton. "For what do you suppose we’re asking you this? We wish to persuade you, to set you on the good path... Your dear papasha wants nothing for you but your own good... And he has asked us as well... Speak frankly... Who is without sin? You took twenty-five roubles from your papasha, that were lying in his chest of drawers, or was it not you?"
– Вы, Серапион Косьмич, будьте откровенны, – говорит дьячок. – Ведь мы вас для чего это спрашиваем? Мы вас убедить желаем, на путь наставить благой... Папашенька ваш ничего вам, окроме пользы вашей... И нас вот попросил... Вы откровенно... Кто не грешен? Вы взяли у вашего папаши двадцать пять рублей, что у них в комоде лежали, или не вы?
Serapion spits to one side and says nothing.
Серапион сплевывает в сторону и молчит.
"Speak, then!" shouts Kuzma Yegorov, banging his fist on the table. "Speak: was it you or not?"
– Говори же! – кричит Кузьма Егоров и стучит кулаком о стол. – Говори: ты или не ты?
"As you please, sir... Let it be..."
– Как вам угодно-с... Пускай...
"Let it be so," corrects the gendarme.
– Пущай, – поправляет жандарм.
"Let it be so, I took it... Let it be! Only it’s no use you shouting at me, papasha. No use banging either. However much you bang, you won’t bang the table through the floor. I never took your money from you, and if I ever did take it, it was out of need... I’m a living man, an animate noun-substantive, and I need money. I’m not a stone!.."
– Пущай это я взял... Пущай! Только напрасно вы, папаша, на меня кричите. Стучать тоже не для чего. Как ни стучите, а стола сквозь землю не провалите. Денег ваших я никогда у вас не брал, а ежели брал когда-нибудь, то по надобности... Я живой человек, одушевленное имя существительное, и мне деньги нужны. Не камень!..
"Go and earn it, if you need money, and there’s nothing to rob me for. You’re not my only one, I’ve got seven of you!"
– Поди да заработай, коли деньги нужны, а меня обирать нечего. Ты у меня не один, у меня вас семь человек!
"That much I understand without your instructing me, only owing to poor health, as you yourself well know, I am consequently unable to earn a living. And as for reproaching me just now with a crust of bread, for that very thing you shall answer before the Lord God..."
– Это я и без вашего наставления понимаю, только по слабости здоровья, как вам самим это известно, заработать, следовательно, не могу. А что вы меня сейчас куском хлеба попрекнули, так за это самое вы перед господом богом отвечать станете...
"Poor health!.. You’ve got a trifling little trade, all you need do is snip and shave, snip and shave, and even that you run away from."
– Здоровьем слаб!.. Дело у тебя небольшое, знай себе стриги да стриги, а ты и от этого дела бегаешь.
"What trade have I got? Is that a trade? It’s not a trade, only some sort of pretension. And my education isn’t of the kind that I could live by that trade."
– Какое у меня дело? Разве это дело? Это не дело, а одно только поползновение. И образование мое не такое, чтоб я этим делом мог существовать.
"You reason incorrectly, Serapion Kosmich," says the sexton. "Your trade is an honorable one, an intellectual one, seeing as you serve in the provincial capital, cropping and shaving intellectual, noble people. Even generals do not disdain your craft."
– Неправильно вы рассуждаете, Серапион Косьмич, – говорит дьячок. – Ваше дело почтенное, умственное, потому вы служите в губернском городе, стрижете и бреете людей умственных, благородных. Даже генералы, и те не чуждаются вашего ремесла.
"About generals, if you like, I can explain to you myself."
– Про генералов, ежели угодно, я и сам могу вам объяснить.
The medical assistant Ivanov is slightly drunk.
Фельдшер Иванов слегка выпивши.
"By our medical reasoning," he says, "you’re turpentine and nothing more."
– По нашему медицинскому рассуждению, – говорит он, – ты скипидар и больше ничего.
"We understand your medicine full well... Who, allow me to ask, last year very nearly cut open a drunken carpenter instead of a corpse? Had he not woken up, you’d have slit his belly open for him. And who mixes castor oil together with hemp oil?"
– Мы вашу медицину понимаем... Кто, позвольте вас спросить, в прошлом годе пьяного плотника, вместо мертвого тела, чуть не вскрыл? Не проснись он, так вы бы ему живот распороли. А кто касторку вместе с конопляным маслом мешает?
"In medicine one cannot do without that."
– В медицине без этого нельзя.
"And who sent Malanya into the next world? You gave her a purgative, then a binding draught, then a purgative again, and she couldn’t stand it. It’s not people you should be doctoring, but, begging your pardon, dogs."
– А кто Маланью на тот свет отправил? Вы дали ей слабительного, потом крепительного, а потом опять слабительного, она и не выдержала. Вам не людей лечить, а, извините, собак.
"The kingdom of heaven to Malanya," says Kuzma Yegorov. "The kingdom of heaven to her. It wasn’t she who took the money, it’s not her we’re talking about... But you, tell us... Did you take it to Alyona?"
– Маланье царство небесное, – говорит Кузьма Егоров. – Ей царство небесное. Не она деньги взяла, не про нее и разговор... А вот ты скажи... Алене отнес?
"Hm... Alyona!.. You might at least be ashamed, in front of the clergy and in front of the gendarme."
– Гм... Алене!.. Постыдились бы хоть при духовенстве и при господине жандарме.
"Just tell us: did you take the money or not?"
– А вот ты говори: ты взял деньги или не ты?
The village elder gets up from the table, strikes a match against his knee, and respectfully holds it out to the gendarme’s pipe.
Староста вылезает из-за стола, зажигает о колено спичку и почтительно подносит ее к трубке жандарма.
"Fff..." the gendarme is annoyed. "You’ve gone and filled my whole nose with sulfur!"
– Ффф... – сердится жандарм. – Серы полный нос напустил!
Having lit his pipe, the gendarme rises from the table, goes up to Serapion, and, looking at him point-blank with malice, shouts in a piercing voice:
Закурив трубку, жандарм встает из-за стола, подходит к Серапиону и, глядя на него со злобой и в упор, кричит пронзительным голосом:
"Who are you? What’s the meaning of this? Why so? Eh? What does this mean? Why don’t you answer? Insubordination? Taking other people’s money? Silence! Answer! Speak! Answer!"
– Ты кто таков? Ты что же это? Почему так? А? Что же это значит? Почему не отвечаешь? Неповиновение? Чужие деньги брать? Молчать! Отвечай! Говори! Отвечай!
"If..."
– Ежели...
"Silence!"
– Молчать!
"If... You just take it easier, sir! If... I’m not afraid! You think a great deal of yourself! And you’re a fool, and nothing more! If papasha wants to hand me over to be torn to pieces, then I’m ready... Tear away! Beat away!"
– Ежели... Вы потише-с! Ежели... Не боюсь! Много вы об себе понимаете! А вы – дурак, и больше ничего! Ежели папаше хочется меня на растерзание отдать, то я готов... Терзайте! Бейте!
"Silence! Do not ta-a-alk! I know your thoughts! You’re a thief? Who are you? Silence! Before whom do you stand? Do not reason!"
– Молчать! Не ра-а-азговаривать! Знаю твои мысли! Ты вор? Кто таков? Молчать! Перед кем стоишь? Не рассуждать!
"Punishment is necessary, sir," says the sexton, and sighs. "If they do not wish to ease their guilt by confession, then it is necessary, Kuzma Yegorych, to give him the rod. That is my judgment: it is necessary!"
– Наказать-с необходимо, – говорит дьячок и вздыхает. – Ежели они не желают облегчить вину свою сознанием, то необходимо, Кузьма Егорыч, посечь. Так я полагаю: необходимо!
"Let him have it!" says the bass Mikhailo, in so low a voice that everyone takes fright.
– Влепить! – говорит бас Михайло таким низким голосом, что все пугаются.
"For the last time: was it you or not?" asks Kuzma Yegorov.
– В последний раз: ты или нет? – спрашивает Кузьма Егоров.
"As you please, sir... Let it be... Tear away! I’m ready..."
– Как вам угодно-с... Пущай... Терзайте! Я готов...
"Flog him!" decides Kuzma Yegorov, and, turning purple, climbs out from behind the table.
– Выпороть! – решает Кузьма Егоров и, побагровев, вылезает из-за стола.
The public hangs over the windows. The ailing crowd at the door and lift their heads. Even the peasant woman with the broken rib lifts her head...
Публика нависает на окна. Расслабленные толпятся у дверей и поднимают головы. Даже баба с переломленным ребром, и та поднимает голову...
"Lie down!" says Kuzma Yegorov.
– Ложись! – говорит Кузьма Егоров.
Serapion throws off his little jacket, crosses himself, and lies down meekly on the bench.
Серапион сбрасывает с себя пиджачок, крестится и со смирением ложится на скамью.
"Tear away," he says.
– Терзайте, – говорит он.
Kuzma Yegorov takes off his belt, looks for a while at the public, as if waiting to see whether someone will help, then begins...
Кузьма Егоров снимает ремень, некоторое время глядит на публику, как бы выжидая, не поможет ли кто, потом начинает...
"One! Two! Three!" counts Mikhailo in his low bass. "Eight! Nine!"
– Раз! Два! Три! – считает Михайло низким басом. – Восемь! Девять!
The sexton stands in the corner and, lowering his eyes, leafs through a little book...
Дьячок стоит в уголку и, опустив глазки, перелистывает книжку...
"Twenty! Twenty-one!"
– Двадцать! Двадцать один!
"Enough!" says Kuzma Yegorov.
– Довольно! – говорит Кузьма Егоров.
"More, sir!.." whispers the gendarme Fortunatov. "More! More! Give it to him!"
– Еще-с!.. – шепчет жандарм Фортунатов. – Еще! Еще! Так его!
"I judge that a little more is necessary!" says the sexton, looking up from his little book.
– Я полагаю: необходимо еще немного! – говорит дьячок, отрываясь от книжки.
"And not so much as a squeak out of him!" marvels the public.
– И хоть бы пискнул! – удивляется публика.
The sick part to let her through, and into the room, her starched skirts rustling, comes Kuzma Yegorov’s wife.
Больные расступаются, и в комнату, треща накрахмаленными юбками, входит жена Кузьмы Егорова.
"Kuzma!" she says, turning to her husband. "What is this money I found in your pocket? Isn’t it the same you were looking for just now?"
– Кузьма! – обращается она к мужу. – Что это у тебя за деньги я нашла в кармане? Это не те, что ты давеча искал?
"That’s the very same... Get up, Serapion! The money’s turned up! I put it in my pocket yesterday and forgot..."
– Оне самые и есть... Вставай, Серапион! Нашлись деньги! Я положил их вчерась в карман и забыл...
"More, sir!" mutters Fortunatov. "Let him have it! Give it to him!"
– Еще-с! – бормочет Фортунатов. – Влепить! Так его!
"The money’s turned up! Get up!"
– Нашлись деньги! Вставай!
Serapion gets up, puts on his little jacket, and sits down at the table. A long silence. The sexton is embarrassed and blows his nose into his handkerchief.
Серапион поднимается, надевает пиджачок и садится за стол. Продолжительное молчание. Дьячок конфузится и сморкается в платочек.
"You’ll forgive me," mutters Kuzma Yegorov, turning to his son. "You, that’s to say... The devil himself couldn’t have known it would turn up! Forgive me..."
– Ты извини, – бормочет Кузьма Егоров, обращаясь к сыну. – Ты из того... Чёрт же его знал, что они найдутся! Извини...
"Never mind, sir. It’s not the first time for us, sir... Don’t trouble yourself. I’m always ready for any manner of torment."
– Ничего-с. Нам не впервой-с... Не беспокойтесь. Я на всякие мучения всегда готов.
"Have a drink... It’ll burn off..."
– Ты выпей... Перегорит...
Serapion drinks, lifts his blue little nose in the air, and strides out of the cottage like a warrior. And the gendarme Fortunatov walks about the yard for a long while afterward, red in the face, eyes bulging, saying:
Серапион выпивает, поднимает вверх свой синий носик и богатырем выходит из избы. А жандарм Фортунатов долго потом ходит по двору, красный, выпуча глаза, и говорит:
"More! More! Give it to him!"
– Еще! Еще! Так его!
