2 It is past six in the morning.
Popikov, a candidate for judicial office currently filling the post of examining magistrate in the settlement of N., is sleeping the sweet sleep of a man who draws travel money, lodging money, and a salary besides. He has not yet gotten around to acquiring himself a bed, and so sleeps on a stack of criminal-record certificates. All is quiet. Not even a sound comes from outside the windows. But now something begins to scratch and rustle behind the door in the entryway, as though a pig had wandered in and were scraping its side against the doorpost. A little while later the door, with a plaintive squeak, opens and closes again. Some three minutes later it opens once more, with such an anguished squeak that Popikov gives a start and opens his eyes.
3 "Who’s there?" he asks, gazing uneasily at the door.
4 A spider-shaped body appears in the doorway – a large, shaggy head with overhanging brows and a thick, disheveled beard.
5 "This here where
the magistrate-fellow lives, or what?" rasps the head.
6 "It is. What do you want?"
8 "Why on earth did you come so early? I summoned you for eleven o’clock!"
9 "And what time’s it now?"
10 "It isn’t even seven yet."
11 "Hm... Not even seven yet... We ain’t got no clocks,
Your Honor... So then, you’ll be the magistrate?"
12 "Yes, I... Well, go on outside, wait there... I’m still sleeping..."
13 "Sleep, sleep... I’ll wait. Waiting’s no trouble."
14 Filaretov’s head disappears. Popikov turns onto his other side, closes his eyes, but sleep does not come back to him. After lying about for another half hour, he stretches with feeling and smokes a cigarette, then, slowly, to draw out the time, drinks three glasses of milk one after another...
15 "Woke me up, the scoundrel!" he grumbles. "I’ll have to tell the landlady to lock the door at night. Well, what am I to do, up at this ungodly hour? The devil take him... I’ll question him now, then I won’t have to bother later."
16 Popikov shoves his feet into his slippers, throws
a cloak on over his underclothes, and, yawning until his jaw aches, sits down at the table.
17 "Come here!" he shouts.
18 The door squeaks again, and Ivan Filaretov appears in the doorway. Popikov opens before him "The Case Concerning the Charge Against
Reserve Private Alexei Alexeyev Drykhunov of the Torment of His Wife
Marfa Andreyeva," takes up his pen, and begins rapidly, in a sprawling judicial hand, to write out the interrogation record.
19 "Come closer," he says, scratching away at the paper with his pen. "Answer the questions... You are Ivan Filaretov, peasant of the village of Dunkino, Pustyrevo township, forty-two years of age?"
20 "That’s right..."
21 "What is your occupation?"
22 "We’re shepherds... We tend the village cattle..."
23 "Have you ever been tried in court?"
24 "That’s right, I have..."
25 "For what, and when?"
27 "That doesn’t count as having been tried."
28 "Well, who’s to know! They held us near five days, as I recall..."
29 The magistrate wraps his cloak tighter around himself and, lowering his tone, says:
30 "You have been summoned as a witness in the case concerning the torment inflicted by Reserve Private Alexei Drykhunov upon
his wife. I must warn you that you are obliged to speak nothing but the plain truth, and that everything said here you will be required to confirm under oath at trial. Now then, what do you know of this matter?"
31 "If I might get my travel fare, Your Honor," mutters Filaretov. "
Rode twenty-three versts, and the horse ain’t mine, Your Honor, gotta pay for her..."
32 "You’ll speak of the travel fare afterward."
33 "Why afterward? Folks told me you gotta ask for the fare in court, else you won’t get it after."
34 "I have no time to discuss travel fares with you!" says the magistrate, growing angry. "Tell me how it happened. How did Drykhunov torment his wife?"
35 "Well, what am I to tell you?" sighs Filaretov, blinking his overhanging brows. "It’s simple enough, there was a fight! I’m driving the cows down to the watering place, see, and along comes somebody’s ducks swimming down the river... Whether they belonged to the gentry or to the peasants,
Christ only knows, but anyway, young
Grishka the herd-boy takes up a stone and starts flinging it at ’em... ’What’re you throwing for?’ I ask him. ’You’ll kill it,’ I say... ’Hit some duck or other, and there you’ll have killed it...’"
36 Filaretov sighs and raises his eyes to the ceiling.
37 "A man now, that you could kill too, but a duck’s a weak sort of creature, you could knock it dead with a splinter of wood... I’m telling him this, and
Grishutka won’t listen... Well, he’s a young’un, you know, no sense in him at all, God preserve us... ’Why won’t you listen?’ I say. ’I’ll box your ears!’ I say. ’Fool!’"
38 "That has nothing to do with the case," says the magistrate. "Tell only what concerns the matter at hand..."
39 "Right you are... Only just then, this very moment, as I was aiming to grab him by the ears, up comes Drykhunov out of nowhere... Walking along the bank with the factory lads, waving his arms about. Face all puffed up and red, eyes bugging clean out of his head, and himself swaying fit to fall... Drunk, may he rot for it! Folks hadn’t even come out of church yet, and there he was already sozzled and raising
the devil. He sees me grabbing the boy by the ears and starts hollering: ’Don’t you dare,’ he says, ’go pulling a Christian soul by the ears! Or else,’ he says, ’you’ll catch it!’ And I says to him, honest and proper... decent-like. ’Go on your way,’ I says, ’you drunkard, you.’ He got riled, comes up to me and, full swing, Your Honor, wham, right across the back of my head! For what? On what account? ’What kind of a magistrate d’you take yourself for,’ I ask him, ’that gives you the right to hit me?’ And he says, ’Now, now,’ he says, ’Vanyukha, don’t take offense, that’s just me being friendly, for a laugh. Such a state of enlightenment’s come over me today,’ he says. ’I reckon myself,’ he says, ’the finest sort of fellow there is... I,’ he says, ’draw twenty roubles’ wages at the factory, and there’s nobody over me but the
director himself... I don’t give a spit,’ he says, ’for anybody else! And so many folks nowadays get themselves done in,’ he says, ’it’s no end of them! Come along,’ he says, ’let’s have a drink!’ ’I don’t want to,’ says I, ’drink with you... Folks ain’t even out of church yet, and here you are wanting to drink!’ And then the other lads that was with him crowd round me like a pack of dogs, pulling at me: ’Come along, come along!’ There weren’t no way for me to stand against the lot of them, Your Honor. Didn’t want to drink, but then, may they all rot for it!"
40 "Where did you go, then?"
41 "We’ve got but the one place!" sighs Filaretov. "We went to the coaching inn, to
Abram Moiseich’s. That’s where we always go. A cursed sort of place it is, empty take it! You know it yourself, most like... If you go along the high road toward Dunkino, on the right you’ll have
the estate of the squire Severin Frantsych, and further right still,
Plakhtovo, and between the two of them stands the inn. You know Severin Frantsych, I expect?"
42 "You must say ’you’ – formally. You mustn’t address me familiarly! If I use the formal ’you’ with you, then you certainly ought to be respectful in turn!"
43 "Quite right, Your Honor! Think we don’t understand? But you listen to what comes next... We get to Abramka’s place... ’Pour it out,’ he says, ’on my money!’"
44 "Who says this?"
45 "Why, that same fellow... Drykhunov, that is! ’Pour it out,’ he shouts, ’you son of a so-and-so, or I’ll stove in the barrel!’ ’Such enlightenment’s come over me,’ he says! We had ourselves a glass each, then waited a bit and had another, and carrying on that way, in an hour’s time we’d downed, God strike me, eight glasses apiece! What’s it to me? I drink, and no trouble to me: it ain’t my money! Bring me a thousand glasses, I wouldn’t mind! I’m not the least bit to blame, Your Honor! You go and question Abram Moiseich, if you like."
46 "What happened after that?"
47 "Nothing happened after. While we were drinking, that’s true, there was a fight, but after that it was all decent and proper."
48 "Who was fighting, then?"
49 "Well, who d’you think... ’Such enlightenment’s come over me,’ he shouts! Shouting, and looking to fetch somebody a clout on the neck. Worked himself into a fury. Hit me, and hit Abramka, and hit the lads too... He’d pour you a glass, give it you to drink, and then hit you with all his might. ’Drink,’ he says, ’and know my strength! I don’t give a spit for the rest of you!’"
50 "And did he beat his wife?"
51 "Marfa, you mean? Marfa got hers too... Just as we were getting into the spirit of things, so to speak, in comes Marfa to the tavern. ’Come home,’ she says, ’
your brother Stepan’s arrived! Enough,’ she says, ’of your vodka-drinking, you villain!’ And he, without a word of warning, wham, right across her back!"
52 "What for?"
53 "Oh, just so, for no reason at all... ’Let her feel it,’ he says... ’I,’ he says, ’draw twenty roubles.’ And she’s a frail sort of woman, thin, so she just doubled right over, her eyes even rolled back. She took to complaining to us of her misfortune and calling on God, and he went at it again... Went on teaching her and teaching her, and there weren’t no end to that lesson!"
54 "And why did none of you intervene? A man crazed with drink is beating a woman half to death, and you pay it no mind!"
55 "And what call have we to get mixed up in it? She’s his wife, he’s teaching her his own way... Two folks fighting, a third don’t meddle... Abramka started in trying to calm him down, so’s he wouldn’t carry on so in the tavern, and he clouted Abramka on the ear. Abramka’s hired man went at him... And he grabbed him up, and threw him down on the ground... Then that fellow sat astride him and started in drumming on his back... We hauled him out from under by the legs."
56 "Hauled whom out?"
57 "Well, who d’you think... The one that was sat astride..."
59 "Why, that same one I’ve been telling you about."
60 "Bah! Speak plainly, you fool! Answer my questions, and don’t go rambling on for nothing!"
61 "I’m telling you plain, Your Honor... everything, just as it was, on my honor. Drykhunov was teaching his woman a lesson, that’s the truth of it... I’ll swear to it."
62 The magistrate listens, picks out what he can from Filaretov’s long and disjointed speech, and scratches away with his pen... Again and again he has to cross something out...
63 "And I’m not the least bit to blame..." mutters Filaretov. "Ask, Your Honor, anybody you like. And the woman ain’t worth dragging through the courts over, neither."
64 Having had the record read back to him, the witness stares blankly at the magistrate for a moment and sighs.
65 "What a trial these women are!" he rasps. "The travel fare, Your Honor – will you pay it yourself, or give me a chit for it?"
